While this consultation does not ask directly for any personal or special category data, nor does it encourage people to share that information, there are free text boxes in which those responding may write what they wish.

As this might include material that would be considered to come under the remit of Data Protection / GDPR, a privacy notice has been included in case such data is recorded, in order to be transparent and compliant with legislation.

The council is the data controller for purposes of the Data Protection Act (2018) and The General Data Protection Regulation (EU) 2016/679 ("GDPR") and is registered as a data controller with the Information Commissioner’s Office (ICO).

As a data controller we have a responsibility to make sure you know why and how your personal information is being collected in accordance with relevant data protection law.

Purposes and lawful basis of processing

We are collecting your data for the purpose of gathering feedback on the way Children’s Services responded to children, families and carers during the COVID-19 lockdown.

We have a lawful basis for processing this data as a legal obligation under the Children Act 2004. We also have as a lawful basis provision of a task carried out in the public interest.

Special category data may be processed under GDPR Article 9 (2) (g) Substantial Public Interest and Article 9 (2) (h) Health and Social Care and the Data Protection Act 2018 Schedule 1 part 1 para 2 (2) (e) and part 2 para 6, under the legislation noted in the paragraph above.

Who we will share your data with

Your information will not be shared with any other third party unless we are under a legal obligation to do so.

How long we will hold your data (retention)

We will hold your data for until the consultation period has ended and the report has been written and circulated.

The maximum the data will be kept is 2.5 years, then it will be deleted.

Transferring data outside the European Economic Area

Your information is not processed outside of the European Economic Area.
