Whilst this consultation does not ask directly for any personal or special category data, nor does it encourage people to share that information, there are free text boxes in which those responding may write what they wish. The report will be complied from the survey information, and all references to personal or special category data will be removed and not included in the report. Any personal or special category data that has been inadvertently collected by Brighton and Hove shall be kept safe and secure, with password-protected access only by those who need to see the information to write the report. The survey data collected will then be manually deleted when the report has been finished.

Purposes & Lawful basis of processing

  • We are collecting your data for the purpose to gather views and feedback on Brighton & Hove City Council’s Post-16 Transport and Travel Support for Education and Training Policy, so a report can be written to be presented to the Council’s Families, Children and Learning (Education and Skills) Home to School Transport Governance Board.
  • We have a lawful basis for processing this data as a Legal Obligation under the Education Act 1996, and Performance of a Task carried out in the Public Interest, under the Department for Education’s Post-16 Transport and Travel Support to Education and Training Statutory Guidance for Local Authorities January 2019
  • Special Category data may be processed under GDPR Article 9 (2) (g) & (h) and the Data Protection Act 2018 Schedule 1 part 2 paragraph 6 & part 2 paragraph (18), under the legislation noted in the paragraph above.

Your information will not be shared with any other third party unless we are under a legal obligation to do so.

How Long we will Hold your Data (Retention)

  • We will hold your data for until the report has been written and submitted to the Council’s Families, Children and Learning (Education and Skills) Home to School Transport Governance Board; this should be no longer than the end of August 2021.
